Steel Mill Test Certificates Required for Iron or Steel Products Classified in Chapter 72 or Headings 7301 to 7307

On July 15, 2014, U.S. Customs and Border Protection (CBP) issued ruling HQ H209833 in response to an internal advice request from the Port Director of Champlain, New York, regarding the steel mill certificate requirement under 19 C.F.R. §141.89Additional information for certain classes of merchandise.

Pratt and Whitney Canada Corporation made entry on various aircraft parts classified under headings 7304 and 7307 (steel pipe fittings, including tubes, elbows, and a union joint). CBP issued a Request for Information requesting the steel mill test certificate for the pipe fittings. When Pratt and Whitney failed to provide the certificate within the 30 day time period, CBP issued a Notice of Action stating the mill test certificate was required to determine whether the merchandise at issue was subject to antidumping duty orders, and is a required document under 19 U.S.C. §1509 (a)(1)(A). After no response to their Notice of Action, CBP issued another letter to Pratt and Whitney informing them that the matter had been referred to CBP’s Enforced Compliance Team for failure to comply with a lawful request for the production of records. The letter stated:

“19 C.F.R. §141.89 outlines additional information requirements for certain classes of merchandise. Iron or steel classifiable in Chapter 72 or headings 7301 to 7307 HTSUS (T.D. 53092, 559977) require a state-ment of the percentages by weight or carbon and any metallic elements contained in the articles, in the form a mill analysis or mill test certificate.”
