EPA ADVANCE NOTICE REQUIREMENT FOR IMPORTS OF 30 CHEMICAL SUBSTANCES

A direct final rule imposing import restrictions on 30 chemical substances has been issued by the Environmental Protection Agency (EPA) that were the subject of a pre-manufacture notice. This rule requires persons intending to manufacture (including import) or process any of these 30 substances for an activity that is designated as a significant new use by this rule, to notify the EPA at least 90 days prior to commencing that activity. This notification will provide the EPA with the opportunity to evaluate the intended use and, if necessary, prohibit or limit that activity before it occurs.

The 30 substances that are subject to this rule are used in fuel additives, solvent-based paints and inks, coatings, surface active agents, polymers, cleaners, consumer products, sealed batteries, pesticides, hydrofluorocarbons, liquid soaps, reaction processes and industrial adhesives.

These chemical substances must by certified by the Importer that they comply with all applicable rules and orders under the Toxic Substances Control Act (TSCA), including any significant new use rule requirements.

Additionally, any persons who export or intend to export any of these chemical substances are subject to the export notification provisions of 15 USC 2611(b) and must comply with the export notification requirements in 40 CFR part 707, subpart D.

This rule will be effective as of December 1, unless written adverse or critical comments (or notice of intent to submit such) are received by November 2, 2015, in which case the EPA will withdraw the relevant sections of this rule before its effective date.

EPA Final Ruling

Effective April 6, 2015 the Environmental Protection Agency will impose import restrictions on the chemical substance pentane, 1,1,1,2,3,3-hexafluoro-4-(1,1,2,3,3,3-hexafluoropropoxy), which was the subject of a pre-manufacture notice.  The EPA issued this final rule requiring persons who intend to manufacture and/or import this substance for any activity that is designated as a significant new use by this rule must notify the EPA at least 90 days before commencing that activity to provide the EPA the opportunity to evaluate the intended use.   If deemed necessary, this will allow the EPA to prohibit or limit that activity before it occurs.

Importers must certify that shipments of this substance comply with all applicable rules and orders under the Toxic Substances Control Act, including any significant new use rule requirements. In addition, any persons who export or intend to export this substance are subject to the export notification provisions of 15 USC 2611(b) and must comply with the export notification requirements in 40 CFR part 707, subpart D.
